The defense in a DWI/DUI case will often depend on whether you took a Breathalyzer test or not:

  • If you took a Breathalyzer test, our lawyers can challenge the breath test results. The Intoxilyzer or Breathalyzer machine used in Texas is outdated and prone to error. The science behind this machine can be questioned through the use of expert witnesses in court.
  • If you didn't take a Breathalyzer test, your case may come down to how you appeared on the video. Most arrests are videotaped in Texas, and if you do not appear to be intoxicated on the video, that is fantastic for your case.

Our lawyers will also look for the reasons for the police stop. If the police did not have a legal reason to pull you over, all evidence collected after the stop, including the Breathalyzer test results and the video, can be dismissed.
